Text Messaging Terms of Service

The HallPass text messaging service is operated by HallPass, LLC (“HallPass,” “we,” “our,” or “us”). These Text Messaging Terms of Service (the “Texting Terms”) govern the provision, receipt, and delivery of text messages by or on behalf of HallPass. Depending on the consent you’ve provided, our texts (the “HallPass Texts”): (1) provide you with information you requested from us; (2) provide updates regarding transactions with or through us; (3) respond to your questions and other inquiries, such as if you contact us for customer support; and/or (4) provide you with promotional content that may interest you.

E-SIGN Disclosure and Agreement

By providing your consent to receive HallPass Texts (as described below), you also consent to the use of an electronic record to document your agreement. You may withdraw your consent to the use of the electronic record by emailing us at support@hallpasscandy.com with “Revoke Electronic Consent” in the subject line.

To view and retain a copy of this disclosure or any information regarding your enrollment in this program, you will need (i) a device (such as a computer or mobile phone) with a web browser and Internet access and (ii) either a printer or storage space on such device. Eligibility

By consenting to receive HallPass Texts, you represent that you are 18 years of age or older and understand the obligations and agree to the terms set forth in these Texting Terms and our Terms of Service. You further represent that you are the subscriber to the relevant phone number or that you are the customary user of that number on a family or business plan and for which you are authorized to opt into HallPass Texts.


Agreement and Consent to Receive HallPass Texts

You can provide us with your consent to receive HallPass Texts in multiple ways, such as by providing us with a phone number so we can send you transactional texts (such as about your purchases or other transactions with us), communicating with our support team, or by opting into receiving promotional HallPass Texts. By providing your consent, you agree to these Texting Terms. 


By providing your consent, you agree to receive recurring text messages from and on behalf of HallPass through your wireless provider to the mobile number you provided, even if your mobile number is registered on any state or federal Do Not Call list. We may offer multiple HallPass Texts programs, and you may provide consent to more than one HallPass Texts program. Text messages may be sent using nonautomated or an automatic telephone dialing system or other technology. Service-related messages may include updates, alerts, and information (e.g., order updates, account alerts, etc.). Promotional messages may include promotions, specials, product launches, and other marketing offers (e.g., cart reminders).

You understand that consent to receiving promotional texts is not a condition of purchase.


Modifying or Canceling HallPass Texts

We may modify or cancel the HallPass Texts service or any of its features without notice. To the extent permitted by applicable law, we may also modify these Texting Terms at any time and your continued enrollment in HallPass Texts following the effective date of any such changes shall constitute your acceptance of such changes.


Costs and Frequency of HallPass Texts

We do not charge for the HallPass Texts service, but you are responsible for all charges and fees associated with text messaging imposed by your wireless provider. Message frequency varies. Message and data rates may apply. Check your mobile plan and contact your wireless provider for details. You are solely responsible for all charges related to SMS/text messages, including charges from your wireless provider.


Opting Out of HallPass Texts

You may opt-out of HallPass Texts at any time. To opt out of HallPass Texts for your mobile number, text STOP to +1 (844) 623-7449. We may not recognize other opt-out commands, and you agree that we are not responsible if you submit opt-out commands that do not comply with these Texting Terms. We may send you an opt-out confirmation text message. You must separately opt out of each number from which you’ve provided us with consent to receive HallPass Texts. If you have consented to multiple HallPass Texts programs, you must also separately opt out of each program. You may thereafter re-enroll in HallPass Texts.

We may change any short code or telephone number we use to operate the HallPass Texts service at any time. You acknowledge that any messages, including any STOP or HELP requests, you send to a short code or telephone number we have changed may not be received and we will not be responsible for honoring requests made in such messages.


The wireless carriers supported by the HallPass Texts service are not liable for delayed or undelivered messages. You agree to provide us with a valid mobile number. If you get a new mobile number, you will need to sign up for the program with your new number. HallPass Texts may not be compatible on all mobile phone models.


To the extent permitted by applicable law, you agree that we will not be liable for failed, delayed, or misdirected delivery of any information sent through the HallPass Texts service, any errors in such information, and/or any action you may or may not take in reliance on the information or HallPass Texts.
